According to a Reuters investigation, Elon Musk's AI company xAI is running 59 gas turbines without required federal clean-air permits at its Colossus 2 data center project — roughly double what the company had publicly acknowledged.

Where the turbines are located

At the Colossus 1 site in South Memphis, Tennessee, thermal imagery identified over 30 turbines operating as of April 2025. At the Colossus 2 site in Southaven, Mississippi, just across the state line, at least 27 unpermitted gas turbines were running as of January 2026.

How the company tried to sidestep regulation

Reportedly, the company tried to bypass the permitting process entirely by classifying the turbines as "mobile" units eligible for a 364-day temporary-use exemption — even though the turbines are actually powering a permanent, continuously operating supercomputer facility.

The scale of the pollution

Estimates suggest that just 30 turbines at one site could emit nearly 2,500 short tons of nitrogen oxide, 4,000 short tons of carbon monoxide, and 22 short tons of formaldehyde annually if run continuously at 80% capacity. Both sites — in South Memphis and Southaven — sit near predominantly Black neighborhoods that already face disproportionately high environmental burdens.

The lawsuit

On April 14, 2026, the NAACP, the Southern Environmental Law Center, and Earthjustice filed a Clean Air Act lawsuit against xAI's operations.

What this means in practice

The story illustrates a broader tension around AI infrastructure: the pace of building data centers to train models often outruns the pace of securing environmental permits, and the cost of that gap falls disproportionately on already-vulnerable communities living near these facilities.
