Circle Wins a New York Trust Charter — USDC's Issuer Now Has Both Federal and State Bank Status

Circle Internet Group (NYSE: CRCL), issuer of USDC — the world's second-largest stablecoin — has secured a limited purpose trust charter from the New York Department of Financial Services (NYDFS). The charter is an official state banking authorization to provide fiduciary, custody, and asset-management services under New York Banking Law.

The NYDFS charter arrives just weeks after Circle won final approval from the Office of the Comptroller of the Currency (OCC) on July 8, 2026 to establish a national trust bank — making it the first stablecoin issuer with a federal banking charter of that kind. Together, the state and federal status give Circle a regulatory moat of sorts against Tether and the OPEN-USD consortium.

The national bank will enhance the safety and regulatory oversight of the USDC Reserve, while enabling Circle to offer fiduciary digital asset custody and related services to institutional customers.

The structure — separating stablecoin issuance from reserve custody — lines up directly with the GENIUS Act, which has pushed fintechs to apply for bank charters en masse over the past year, in what industry watchers describe as a "now-or-never" moment of regulatory receptivity. Market reaction was muted, though: CRCL shares didn't move much on the news, while bitcoin slid to $64,000 in the same stretch. Former Barclays CEO Bob Diamond already argued the GENIUS Act mainly benefits big banks — Circle's move looks like the same dynamic playing out on the stablecoin-issuer side instead.
