Sen. Wyden Demands CLARITY Act Keep Developer Protections

Oregon Senator Ron Wyden sent a letter to Senate leaders John Thune and Chuck Schumer urging them to preserve Section 604 of the CLARITY Act, known as the Blockchain Regulatory Certainty Act (BRCA), as the bill moves through the legislative process, The Block reports.

What the provision actually does: the BRCA creates a legal safe harbor for developers of non-custodial blockchain software — software that doesn't hold or control user funds — so they aren't legally classified as money transmitters, CryptoTimes explains.

The crypto industry broadly supports the provision, arguing it gives developers needed legal clarity and keeps innovation from moving offshore. Some law-enforcement and religious groups oppose it, arguing it could weaken safeguards against human trafficking and hinder investigations.

What this means in practice: time is tight — Congress is approaching its August recess, with less and less floor time left before the November election. We've already covered how the CLARITY Act's July 4 deadline already collapsed; Wyden's letter shows the fight over the bill's specific language continues even without a hard deadline.
