After four years of delays, South Korea is finally taxing crypto — with a built-in 'we'll fix it later'
South Korea's Ministry of Economy and Finance has confirmed that a capital gains tax on crypto will take effect on January 1, 2027. The rate is 20% plus a local tax, for a combined 22% on profits above a tax-free threshold of roughly ₩2.5 million (about $1,800) a year, CryptoTimes reports. The law was originally supposed to start back in 2022, but was postponed three times in a row, citing unready tax infrastructure and implementation concerns.
“We currently assume that taxation will proceed as scheduled starting next year. If necessary, we are willing to review and supplement the system after implementation”
— Koo Yun-cheol, Deputy PM and Finance Minister of South Korea
- The tax-free threshold is ₩2.5 million in annual profit; anything above that is taxed at 22%
- Lawmaker Kim Sang-hoon criticized the lack of a loss-carryforward mechanism, arguing it could weaken domestic investment and push capital abroad
- The government responded that stock-trading losses aren't carried forward under the current tax system either, since they're classified as "other income"
- Industry participants worry the missing loss-carryforward rule specifically could push investor capital out of Korea's digital asset market and overseas
The tax arrives just as South Korea is separately speeding up its blockchain push and preparing a dedicated digital asset law — meaning the country is tightening the tax screws and building a clearer regulatory framework for the industry at the same time. Whether it can pull off both without an investor exodus should become clear within the first months of 2027.
