A failed Clarity Act could speed up SEC and CFTC crypto rules

While the Clarity Act vote stalls in the Senate, Bernstein analysts are warning of a counterintuitive effect: a failed bill won't stop US crypto regulation — it will accelerate it, just in different hands.

  • The Senate has one week left before the August 7 recess, and Galaxy Research puts the odds of passage this year at around 30%

CFTC Chair Michael Selig had already warned of exactly this scenario, calling the current lack of a unified federal framework a "patchwork" of state laws that's bad for business. Bernstein's analysts, meanwhile, call the Clarity Act "the most consequential crypto market structure bill in U.S. history" and admit its failure would be disappointing. But in their view, the market would only see a brief negative knee-jerk reaction, while regulatory support from the SEC and CFTC wouldn't stall — it would pick up speed.

We already covered how the Senate won't finish a Clarity Act vote before recess, with Lummis and Warren blaming each other for the delay. If Bernstein is right, that's not the same thing as a regulatory vacuum for the industry: instead of one law written by Congress, the rules would be assembled from separate decisions by two agencies — faster, but less predictable too.
