ChatGPT Health Goes Nationwide — But Without HIPAA Protection

OpenAI has launched ChatGPT Health to all adult users in the US — the feature went live on web and iOS on July 23 across every tier, from Free to Pro, Gizmodo reports. This isn't an experiment anymore: over 300 million people a week already ask ChatGPT health-related questions, and now they can connect real medical data directly to the chat.

OpenAI itself gives an example of the intended benefit: "ChatGPT can consider a dietary restriction when helping you choose a restaurant, or a recent injury when planning lower-impact weekend activities with your family" — while adding: "We encourage people to verify important information and discuss medical decisions with their healthcare provider," per Gizmodo.

The key caveat that tends to get lost in the enthusiasm: once medical records enter ChatGPT, they're no longer protected under HIPAA. That law only covers data held by your doctor or insurer — not apps like ChatGPT, which aren't formally "covered entities" under the statute. OpenAI voluntarily commits to similar protections — no model training on the data, no ad targeting, 30-day deletion once disconnected — but these are the company's own voluntary promises, not a federal legal requirement, HIPAA Journal explains.

Notably, the nationwide rollout coincides with two active lawsuits against OpenAI — one tied to a fatal case following medication advice, another involving a missed pulmonary embolism diagnosis; both seek to pause the service and impose additional regulatory guardrails.
